What Obligations Does the Listing Agent Have to the Seller?

Today I received a call from a Buyers Agent's asking me to disclose to her what the Seller would accept as an offer?  I simply replied the listing price is $350,000, I know the homeowner will accept $350,000.

My question to the agent was "Is this an ethical question that you are asking me?"  Her reply was "Other agents don't have a problem answering the question."  Then I asked her. "Would she answer that question if she was the listing agent?  Her reply was "If I felt we could go to closing then yes, she had no problem giving the buyer's agent the seller's financial information in order to get a deal done."

My question to you is this ethical?  The answer is NO.  In today's economy listing agents and buyers agents are teaming up 'to get the deal done' at the expense of the homeowner who hired the listing agent to represent his/her interest in the selling of their home.

Does the seller have any idea what is happening behind the scenes with the buyer's agent and listing agent?  Probably not.  Will this hurt the seller if the listing agent gives the buyer's agent the seller's financial information?  Yes it would.

Traditional Real Estate has changed.  What use to be an ethical is thrown out the window 'just to get a deal done and go to closing.'  Why is this?  Agents do not get paid a commission unless they go to closing.

From the time a buyer drives up to your driveway from the time they leave, they should feel as though they could live in your house. The goal for selling all real estate, no matter the price range, is for a property to look good, feel good, smell good and to be priced right. If any of the first three requirements cannot be met, the price needs to be adjusted accordingly. Therefore, you want to clean every inch of your property from front to back. Even in cases where a house is in need of upgrades, if the property is clean it will show better and a buyer can view the changes they would make if they lived there.

CLEANING
Show case to Sell!
Cleaning should include touching up walls with paint, shampooing carpets, replacing burned out light bulbs, replacing front and back doormats, and packing away clutter. Invite friends over and ask their opinion about what you should pack away. You also may want their advice on furniture placement, drapes that need to come down, and any other items that may impede a buyer from making an offer to purchase. Remember – once you decide to sell, your home must transform into property for sale. This means that you must detach from all personal attachments to the home. Stay focused on your goal, which is to move and build new memories.

PAINTING
Painting is a tricky item. You want your home to appear neutral. On the other hand, if you have beautiful paint that shows well but is not necessarily neutral, it may or may not be beneficial to make changes. Again, ask a trusted neighbor or friend. You can also invite feedback from the very first prospects. Tell them that your feelings will not be hurt; you simply want to improve the property. Listen carefully to objections and if you offer to paint, you just may find yourself in negotiations. You most definitely want to paint walls, staircases, and other areas that are in obvious need of touching up.

THE YARD
You need to have buyers at “Hello!” This means that yards need to look their very best regardless of the season. Fresh pine straw should be placed in and around all flowerbeds. In addition, sticks, leaves, and other yard “litter” should be raked, bagged, and discarded. Dead plants should be removed and replaced, if the season permits, with live ones. Adding color to landscaping, even if the yard is not professionally maintained, is a huge bonus. Placing pots of flowers or plants on either side of the front door is always inviting.

If you have animals, especially dogs, make sure that all feces are picked up and discarded properly. You do not want buyers stepping in messes in the yard. Also, if there are cigarette butts, children’s toys, or any other clutter in the yard, you will want to clear those items. Storing children’s toys in crates in the garage is a great way to keep areas tidy. This also makes toys accessible when buyers are not visiting.

There are six key factors that determine the sale of your property:

Accessibility
If buyers cannot view your property then you cannot sell it. Most buyers will want to take a second or third look before writing an offer. Tips for Working With Buyer Agents in Real Estate


Occasionally a real estate agent will make an appointment to show your home and then stand you up. This happens for several reasons. 1) You were not the first home on the tour and the buyers wanted to make an offer on the first house they viewed. 2) The realtor schedules appointments, sets his/her entire day aside to spend with buyers that do not show up for their appointment. 3) The agent over scheduled the tour and daylight hours have disappeared.              

Working with Buyer Agents 
No matter the reason, this is very frustrating for you. We have asked that you keep a log of all agents calling to see your home. If an agent schedules an appointment and you decide to stay home instead of leaving, you need to contact the agent if more than thirty minutes has passed from your agreed upon time.

Let us examine the reasons for you to excuse yourself during all showings, if possible. First, buyer’s agents will corner you and begin asking questions that may curb a buyer’s excitement about your property. While you do not want to hide any defects regarding the property, you also do not want to blow the chances of a buyer making an offer to purchase. Second, buyers are out to shop. If you are present, buyers will not open cabinets, drawers, and go through the attic or basement. This is because they feel as if they are intruding upon your space instead of inspecting “a house” for purchase. Remember, stage your property as just that – property for sale.

Most homeowners do not want to be present during appointments. Whether you are present or not, it is wise to set up a “work station” on your dining room table for agents. This station should include a basket for their business card and a 3-ring binder with copies of the following: Sellers Disclosure, Termite Letter, Appraisal, Pre-inspection, Legal Description, and any other community information you wish to share. It is a good idea to place these items in a notebook with sheet protectors so that agents do not walk away with your copies.

Important Note: You may want to post signs at all doors reminding real estate agents to turn off lights and lock all doors when leaving. It is also a good idea to board your family pets or take them to a neighbor’s house for the day. We recommend this during all Open House events, too. Relying on real estate agents to ensure your pets don’t escape is not the best idea. Unfortunately this happens in the field too often. Keep your pets and property safe!

Most real estate agents will not even place a buyer in their car without first knowing how much house they can afford, the source for earnest money, and how soon they can close.
