What Obligations Does the Listing Agent Have to the Seller?

Today I received a call from a Buyers Agent's asking me to disclose to her what the Seller would accept as an offer?  I simply replied the listing price is $350,000, I know the homeowner will accept $350,000.

My question to the agent was "Is this an ethical question that you are asking me?"  Her reply was "Other agents don't have a problem answering the question."  Then I asked her. "Would she answer that question if she was the listing agent?  Her reply was "If I felt we could go to closing then yes, she had no problem giving the buyer's agent the seller's financial information in order to get a deal done."

My question to you is this ethical?  The answer is NO.  In today's economy listing agents and buyers agents are teaming up 'to get the deal done' at the expense of the homeowner who hired the listing agent to represent his/her interest in the selling of their home.

Does the seller have any idea what is happening behind the scenes with the buyer's agent and listing agent?  Probably not.  Will this hurt the seller if the listing agent gives the buyer's agent the seller's financial information?  Yes it would.

Traditional Real Estate has changed.  What use to be an ethical is thrown out the window 'just to get a deal done and go to closing.'  Why is this?  Agents do not get paid a commission unless they go to closing.

Flat Fee Real Estate has changed the dynamic of real estate giving the homeowner total control in their sale without the listing agent 'selling them out' just to 'get the deal done.'

By using Total Choice Realty's Flat Fee Listing Service, homeowner are able to negotiate a deal directly with the buyer's agent without a 3rd party agent (listing agent) giving away critical information that could harm the seller's in the negotiation of their home.

6 Strategies to Selling Your Home Without a Realtor!

Atlanta - Selling your home "by owner" in today's market place is simpler then ever without all the cost or hassles.
  1. ACCESSIBILITY - the more the home is shown the faster the home will sell.  Holding your home open every weekend that you are home is critical to getting your property sold.

  2. LOCATION - the old saying Location, Location, Location is still valid in today's real estate market.  As a homeowner you can not change the location of the property, however, you can change the asking price to compensate for either a quality location or poor location.

  3. MARKET CONDITION - the number of buyers in the market place at any given time.  Lots of homes on market equals buyer's market, while fewer home on market dictates a seller's market.

  4. CONDITION - Is the property show ready?  Condition updated?  Does the property have hardwood floors, granite counter tops, or worn carpet and laminate counters?  Pricing your home according to the property condition is important to getting your home sold.

  5. PRICE - Pricing your home 10% below your competition gives the homeowner the competitive edge they need to getting their home sold.

  6. MARKETING - Just about every buyer is searching the top real estate sites for properties for sale.  If your home is not listed on these internet sites you are missing over 90% of the buyers.
Today's savvy homeowners are marketing their properties on the same top Real Estate sites that Realtors use without having to give up their "by owner" status or pay a 6-7% commission to a Realtor to list their property.

Homeowners that advertise their properties for sale as "broker protected" may now list their property on the same Realtor's MLS and on all the top Real Estate sites including Realtor.com for a Flat Listing Fee.  At closing the Seller pays a commission (3% +/-) to the agent that brings them a qualified buyer.

Homeowners also keep their "by owner" status and show and sell their properties themselves.  If the owners sell their property to a buyer not working with an agent they pay NO COMMISSION!

BEWARE! Not ALL Atlanta Flat Fee Companies are the Same!

Georgia Flat Fee

Flat Fee Companies are NOT the Same!

Flat Fee Companies that show a national map or multiple states are lead generation companies. They are not license in Georgia and are not members of our Multiple Listing Service (GAMLS and FMLS).

These companies will resale your lead to a license Georgia Real Estate Broker to service the listing.  You loose total control in what agency will list the property and what services they actually provide.

Almost all Flat Fee companies use your listing to work buyers.  Buyers will call the listing agency that has the property listed and the listing agency will show your property, all buyer leads will go to their buyer's agents and not the homeowner.

By using Total Choice Realty's Flat Fee Listing Service we will provide you with a customized 'For Sale By Owner' yard sign and a brochure box FREE of charge.  Buyers will call you direct to see your home.
When choosing a Flat Fee company don't be fooled by low fees. Compare apples to apples and oranges to oranges.  Don’t assume they are all the same.  You may end up paying for more than what you bargain for and loosing valuable buyers.

Showcasing Your By Owner Property to SELL!

SHOWCASING
From the time a buyer drives up to your driveway from the time they leave, they should feel as though they could live in your house. The goal for selling all real estate, no matter the price range, is for a property to look good, feel good, smell good and to be priced right. If any of the first three requirements cannot be met, the price needs to be adjusted accordingly. Therefore, you want to clean every inch of your property from front to back. Even in cases where a house is in need of upgrades, if the property is clean it will show better and a buyer can view the changes they would make if they lived there.

CLEANING
Show case to Sell!
Cleaning should include touching up walls with paint, shampooing carpets, replacing burned out light bulbs, replacing front and back doormats, and packing away clutter. Invite friends over and ask their opinion about what you should pack away. You also may want their advice on furniture placement, drapes that need to come down, and any other items that may impede a buyer from making an offer to purchase. Remember – once you decide to sell, your home must transform into property for sale. This means that you must detach from all personal attachments to the home. Stay focused on your goal, which is to move and build new memories.

PAINTING
Painting is a tricky item. You want your home to appear neutral. On the other hand, if you have beautiful paint that shows well but is not necessarily neutral, it may or may not be beneficial to make changes. Again, ask a trusted neighbor or friend. You can also invite feedback from the very first prospects. Tell them that your feelings will not be hurt; you simply want to improve the property. Listen carefully to objections and if you offer to paint, you just may find yourself in negotiations. You most definitely want to paint walls, staircases, and other areas that are in obvious need of touching up.

THE YARD
You need to have buyers at “Hello!” This means that yards need to look their very best regardless of the season. Fresh pine straw should be placed in and around all flowerbeds. In addition, sticks, leaves, and other yard “litter” should be raked, bagged, and discarded. Dead plants should be removed and replaced, if the season permits, with live ones. Adding color to landscaping, even if the yard is not professionally maintained, is a huge bonus. Placing pots of flowers or plants on either side of the front door is always inviting.

If you have animals, especially dogs, make sure that all feces are picked up and discarded properly. You do not want buyers stepping in messes in the yard. Also, if there are cigarette butts, children’s toys, or any other clutter in the yard, you will want to clear those items. Storing children’s toys in crates in the garage is a great way to keep areas tidy. This also makes toys accessible when buyers are not visiting.

Three Ways to Sell Your By Owner Property

Least Effective
We have all seen the "For Sale by Owner" signs. On the surface, it looks so easy. Just place a sign in the yard, wait for the calls, and sell the property for the highest dollar to the most qualified buyer. In reality, this is not exactly the road that most "FSBO’s" follow. The fact is 90% of all homes sold are through the Multiple Listing Service.

Sell By Owner on MLS
Once you place a sign in your yard, the majority of inquiries will be from real estate agents wanting to list your property. The second most popular inquiries will be from people wanting to lease/purchase, rent, or finance the property from you. Then there are those buyers that are working with a real estate agent who happen to stumble across your property. Even if you are willing to "protect" agents, the fact that the agent may not have access to your home the minute a buyer sees your sign and that the agent has no information about your home readily available, may deter the agent from getting actively involved in the transaction. Therefore, you could possibly lose potential buyers.

So, instead of worrying about "protecting agents," why not give Total Choice Realty the opportunity to protect you! Let’s look at the second way to sell your property.

Shows like 20/2060 Minutes, and Prime Time along with both Realtor Associations and Consumer-Awareness Survey Companies have shown that most buyers want to utilize the assistance of a real estate agent when purchasing property. These same sources have also reported that the majority of homeowners that attempt to market and sell their property eventually contract with a real estate broker to list their home.

Most Expensive
Hiring a "traditional" real estate company will cost you between six to seven percent (6-7%) commission at the closing table. Let’s examine some hard figures in an effort to gain a clearer perspective on why you should seriously consider Total Choice Realty to list your property.
When a homeowner decides to list their property with a traditional real estate broker, he/she considerably reduces profits received at the closing table. If your home sells for $200,000 and you pay 6% in commission, you are going to be paying $12,000 in real estate commission.

So, homeowners face two challenges:

     1) 90% of all homes sold are SOLD through the MLS; and
     2) Listing property through a traditional real estate company is expensive.

Total Choice Realty is your Total Solution. Hire us for a fraction of the cost, have your property listed on MLS, and retain the rights to show, sell, and advertise your property.

What is the Multiple Listing Service (MLS)?
All real estate companies across the United States have the same access to a multiple listing service. While different real estate companies choose different MLS services, the services all have the same goal – give active real estate brokers information on current properties. MLS services provide information such as number of bedrooms, number of bathrooms, property features, and more. MLS also allows pictures to be posted with the property description. The MLS saves buyers time since they are able to select homes on the Internet or in a real estate office prior to actually visiting properties.

Listing Agent Motives (Traditional Real Estate Brokers)
The first priority of the Listing Agent is to list your home on a multiple listing service (MLS/FMLS). Most Listing Agents will tell you that their first goal is to get your home sold and that they will do everything in their power to make this happen. However, according to the National Association of Realtors, the basic complaints Sellers have about their listing agent are:

1. The Listing Agent listed the property and was never seen or heard from again.
2. The Listing Agent never actually showed the property.
3. All the Listing Agent accomplished was placing property on the MLS, placing a sign in the yard, and providing a lockbox.

Consumers now understand that they are paying for two real estate agents to sell their home when only one of the agents does the majority of the work – the agent that brings the buyer. Homeowners are fighting back and Total Choice Realty gives you the tools you need to WIN!
Since we are NOT a traditional real estate company, we do NOT operate in the traditional way. We want you to feel good about your home selling experience. This means that you need to accomplish the following:

1. Have your home listed on MLS to attract 90% of the buyers.
2. Have a sign, flyers, a lockbox, and tools to get your home sold – NOT just listed.
3. Total Control in the sale of your property.

With Total Choice Realty, you gain you all the support you need, for a nominal flat fee, and you maintain Total Control.

6 Factors to Getting your Home SOLD By Owner

SIX FACTORS ARE THE KEYS TO SOLD!
Getting to SOLD

There are six key factors that determine the sale of your property:
•Accessibility
•Condition
•Price
•Motivation
•Location
•Supply and Demand

All of these factors add up to getting your by owner property SOLD - period. Let’s take a look at how this works.

Accessibility
If buyers cannot view your property then you cannot sell it. Most buyers will want to take a second or third look before writing an offer. Therefore, you need to have an “open house” twenty-four hours a day, so to speak. This is why it is crucial to have your property listed with MLS and have a lockbox for buyer agents to bring buyers to your home during the times that you cannot be present. The more buyers that walk through your home, the greater your odds for a quicker sale.

Tip: Anytime you are home and is reasonable, place an “Open House” sign in your yard.

Condition/Keeping up with the Jones’s
This is probably the most important factor in this equation. You must have an excellent product to sell. Television shows such as “Flip This House,” and “Extreme Makeover” have educated buyers so much so that they now want “move-in” ready homes. In other words, you will need to spruce up the house and pay special attention to our Showcasing section below. Total Choice Realty has provided a “To Do” list to assist with the details necessary to have your property/product in tip-top shape. We provide the information; you make the choice of what to change. Just remember, the fewer changes you make to position your product to sell, the lower the price.

Price Sells
As a seller you must accomplish several tasks in order to get your by owner property sold. The first and foremost is price. If your property is not priced to sell, it will sit unsold for months or sometimes years.

Therefore, if you are in no hurry to move, you can price your property higher and wait for a qualified buyer. However, if you need to move quickly due to any type of life change, you will need to price your property lower. To familiarize yourself with homes in your neighborhood or community that have recently sold, contact us and we will give you a FREE Comparative Market Analysis. This report will show you recently active, expired, under contact and sold properties in your neighborhood. Then you can make the choice of how you want to price your home.

Motivation
How motivated are you to sell your property? Are you motivated enough to take the necessary steps to get it sold? Are you going to let negotiations of a few hundred dollars stand in the way? Weigh your answers to these questions heavily. If you are completely motivated then you must do what isrequired to get the property from “for sale” to “sold.” If you are not completely motivated, your home will sit on the market while buyers are placing offers with the most motivated sellers.

Location
When you purchased your current property, location was a factor in your decision making. As a matter of fact – there is a real estate saying, “Location! Location! Location!” Since you cannot physically move your residence, you must take location into consideration. If there have been major changes in your community since you purchased your home, these changes will affect the decisions of potential buyers. Perhaps you are in an area of extreme growth – or you may be in an area that has become under populated. Wise sellers take “outside” factors into consideration for pricing and marketing purposes.

Supply and Demand
If your property is located in a community where many homes are on the market, you must understand that your property may take longer to sell. Buyers with many choices will be much more selective and will be looking for “the best deal.” For those fortunate sellers that must sell when there are already many properties listed face a greater challenge of product presentation and deciding on the right price. Homes are just like any other product. When the supply is higher, the price is lower and when the supply is low, the price can be slightly higher because demand justifies the means.

Just remember, whether your house is listed with a traditional real estate broker, or Total Choice Realty . .

Tips for Working With Buyer Agents

Tips for Working With Buyer Agents in Real Estate

Occasionally a real estate agent will make an appointment to show your home and then stand you up. This happens for several reasons. 1) You were not the first home on the tour and the buyers wanted to make an offer on the first house they viewed. 2) The realtor schedules appointments, sets his/her entire day aside to spend with buyers that do not show up for their appointment. 3) The agent over scheduled the tour and daylight hours have disappeared.

Working with Buyer Agents
No matter the reason, this is very frustrating for you. We have asked that you keep a log of all agents calling to see your home. If an agent schedules an appointment and you decide to stay home instead of leaving, you need to contact the agent if more than thirty minutes has passed from your agreed upon time.

Let us examine the reasons for you to excuse yourself during all showings, if possible. First, buyer’s agents will corner you and begin asking questions that may curb a buyer’s excitement about your property. While you do not want to hide any defects regarding the property, you also do not want to blow the chances of a buyer making an offer to purchase. Second, buyers are out to shop. If you are present, buyers will not open cabinets, drawers, and go through the attic or basement. This is because they feel as if they are intruding upon your space instead of inspecting “a house” for purchase. Remember, stage your property as just that – property for sale.

Most homeowners do not want to be present during appointments. Whether you are present or not, it is wise to set up a “work station” on your dining room table for agents. This station should include a basket for their business card and a 3-ring binder with copies of the following: Sellers Disclosure, Termite Letter, Appraisal, Pre-inspection, Legal Description, and any other community information you wish to share. It is a good idea to place these items in a notebook with sheet protectors so that agents do not walk away with your copies.

Important Note: You may want to post signs at all doors reminding real estate agents to turn off lights and lock all doors when leaving. It is also a good idea to board your family pets or take them to a neighbor’s house for the day. We recommend this during all Open House events, too. Relying on real estate agents to ensure your pets don’t escape is not the best idea. Unfortunately this happens in the field too often. Keep your pets and property safe!

Atlanta Real Estate Broker Protected

Consumer Confidence

Homeowners are more willing than ever to “protect” agents. As a matter of fact, the common response from a homeowner to an agent seeking a listing is, “Bring me a buyer and I will pay you a commission.” As a homeowner considering or already attempting to sell your home, you can probably completely relate.
"Agent Protected"

With Total Choice Realty, the buyer’s agent can bring you a buyer. You can also conduct your own marketing campaign, and if you find a buyer on your own, you save a commission. If you list your property with a traditional real estate broker and find your own buyer, you still have to pay the 6-7% commission. It doesn’t seem quite fair or logical, does it? Of course not! At Total Choice Realty we do not expect to receive money from your efforts.

Consumer confidence in the real estate profession has diminished 30% since 2000. The reason for this is complex and based mostly on service (or lack thereof). Consumers are beginning to demand to be shown more in-depth services besides a sign in the yard and a lockbox on the door.
This is where Total Choice Realty comes into the picture.

Total Choice Realty receives a flat fee for the same services that consumers know they are receiving from a traditional real estate broker at a much higher price. ALL of our flat fee packages include a yard sign customized with the homeowner phone number. You will receive a flyer box (keep it full), flyer templates listing you as the contact person, and all the real estate forms and disclosures you need. We only utilize the official Georgia Association of Realtor forms.

GA for Sale By Owner: The Role of the Buyer’s Agent

GA for Sale By Owner: The Role of the Buyer’s Agent: "Flat Fee By Owner MLS When a buyer decides to work with an agent, the first thing the buyer must accomplish is proving financial stability..."

The Role of the Buyer’s Agent

Flat Fee By Owner MLS
When a buyer decides to work with an agent, the first thing the buyer must accomplish is proving financial stability. Most real estate agents will not even place a buyer in their car without first knowing how much house they can afford, the source for earnest money, and how soon they can close.

Once the buyer has been approved for a loan, they are free to begin searching for the new home. The agent will input the buyer’s criteria into the MLS and then carefully review the results in order to capitalize on their time together.

Once the buyers have decided which homes to visit, the agent will look at the appointment instructions and begin contacting homeowners. The bottom line – the role of the buyer’s agent is to find prospects a home to purchase. Most buyer agents drastically limit the time they are willing to spend with buyers in order to reduce confusion. If an agent shows a buyer too many homes, the buyer can begin to feel overwhelmed. Therefore, make sure your property is available and that it is in top-notch condition.

The Role of Total Choice Realty
We want you to handle the negotiating stage the best way that gives you a complete comfort level. Therefore, if you want to represent yourself, this is covered in our Flat Fee Listing Service. On the other hand, if the thought of representing yourself is overwhelming, you can hire us for 1% of the sales price payable at closing.

If you decide to represent yourself, the buyer’s agent will receive instructions from Total Choice Realty to negotiate all offers directly with you. Even though you will be performing the negotiating, Total Choice Realty signs the contracts and the commission form for the closing attorney.

If you decide to have Total Choice Realty represent you in the negotiating stage, all phases will be handled from the Seller’s Net Sheet to closing. Also, keep in mind; most agents that are showing prospective buyer’s property are Buyer’s Agents. In other words, they represent the buyers in a client-privilege relationship. Total Choice Realty understands that you may feel intimidated or ill prepared to represent your side of the transaction. If this is the case, we will hold your hand every step of the way. The choice is up to you!

How to Sell For Sale By Owner on the MLS

For Sale By Owner
THREE WAYS TO SELL YOUR PROPERTY
Atlanta Real Estate for Sale By Owner

Least Effective

We have all seen the “For Sale by Owner” signs. On the surface, it looks so easy. Just place a sign in the yard, wait for the calls, and sell the property for the highest dollar to the most qualified buyer. In reality, this is not exactly the road that most “FSBO’s” follow. The fact is 90% of all homes sold are through the Multiple Listing Service. The “MLS” service will be explained, in detail, in the next chapter.

In-depth research from sources such as television shows like 20/20, 60 Minutes, and Prime Time along with both Realtor Associations and Consumer-Awareness Survey Companies have shown that most buyers want to utilize the assistance of a real estate agent when purchasing property. These same sources have also reported that the majority of homeowners that attempt to market and sell their property eventually contract with a real estate broker to list their home.

Therefore, you could possibly lose potential buyers.

So, instead of worrying about “protecting agents,” why not give Total Choice Realty the opportunity to protect you! Let’s look at the second way to sell your property.

Most Expensive
Hiring a “traditional” real estate company will cost you between six to seven percent (6-7%) commission at the closing table. Let’s examine some hard figures in an effort to gain a clearer perspective on why you should seriously consider Total Choice Realty to list your property.

When a homeowner decides to list their property with a traditional real estate broker, he/she considerably reduces profits received at the closing table. If your home sells for $200,000 and you pay 6% in commission, you are going to be paying $12,000 to real estate agents!

Total Choice Realty is your Total Solution. Hire us for a fraction of the cost, have your property listed on MLS, and retain the rights to show, sell, and advertise your property.
